Introduction

Welcome to Wemo (Wemo App), an integrated delivery platform connecting you with stores and pharmacies in the city of Hebron. These Terms and Conditions (“Terms”) govern your use of the Wemo application and all related services.

Please read these Terms carefully before using the app. By using Wemo, you agree to be bound by these Terms. If you do not agree to any part of these Terms, you must stop using the app immediately.


1. Definitions

For the purposes of these Terms, the following terms shall have the meanings indicated:

  • “App” or “Wemo”: The Wemo mobile application and all related services

  • “We,” “Us,” “Our,” or “Company”: The operator and owner of the Wemo app

  • “You,” “User,” or “Customer”: Any person who uses the app or requests its services

  • “Shop,” “Store,” or “Pharmacy”: Commercial entities registered on the app that provide products

  • “Driver” or “Courier”: The person responsible for delivering orders

  • “Order”: A request to purchase products or services through the app

  • “Services”: All services provided through the app, including ordering and delivery

  • “Content”: Texts, images, videos, logos, and any other materials on the app

  • “Account”: The user account registered on the app


2. Acceptance of the Terms

2.1 Consent

By accessing or using the app, you:

  • Acknowledge that you have read and fully understood these Terms

  • Agree to be bound by these Terms and our Privacy Policy

  • Undertake to comply with all applicable laws and regulations

2.2 Legal Capacity

To use the app, you must:

  • Be at least 16 years old

  • Have the legal capacity to enter into binding contracts

  • Not be prohibited from using the services under any law

If you are under 18, a parent or legal guardian must supervise your use.

2.3 Modifications

We reserve the right to modify these Terms at any time. We will notify you of material changes via:

  • In-app notice

  • Email

  • SMS

Your continued use of the app after changes constitutes acceptance of the updated Terms.


3. Description of Services

3.1 Service Scope

The Wemo app provides an electronic platform that enables you to:

  • Browse products from local stores and pharmacies

  • Order products electronically

  • Pay cash on delivery

  • Track your orders in real time

  • Receive products at the specified location

3.2 Wemo’s Role

Wemo acts as an intermediary only:

  • We connect users with participating shops

  • We do not own products nor sell them directly

  • Participating shops are responsible for product quality and availability

  • We provide delivery services to facilitate the process

3.3 Availability of Services

  • Services are available in Hebron and designated areas

  • Working hours may vary by shop and area

  • We may temporarily suspend services for maintenance or updates

  • Services may be affected by weather conditions or emergencies

3.4 Continuous Improvement

We reserve the right to:

  • Add or remove app features

  • Update the user interface

  • Expand or reduce the scope of services

  • Discontinue service in certain areas


4. Registration and Account

4.1 Account Creation

To fully use the app, you must:

  • Create an account with accurate and complete information

  • Provide a valid phone number for verification

  • Create a strong password

4.2 Account Information

You are responsible for:

  • The accuracy and completeness of the information you provide

  • Updating your information when it changes

  • Keeping your login credentials confidential

  • All activities that occur under your account

4.3 Account Security

You must:

  • Not share your password with anyone

  • Notify us immediately of any unauthorized use of your account

  • Log out on shared devices

  • Use two-factor authentication if available

4.4 One Account per Person

  • Only one account per user is permitted

  • Creating multiple accounts to exploit offers is prohibited

  • We reserve the right to suspend duplicate accounts

4.5 Account Suspension

We may suspend or terminate your account if you:

  • Violate these Terms

  • Provide false or misleading information

  • Use the services fraudulently

  • Abuse or attempt to hack the system

  • Engage in conduct harmful to other users or the app’s reputation


5. Orders and Purchasing

5.1 Placing Orders

When placing an order, you must:

  • Select products accurately

  • Provide a correct and complete delivery address

  • Choose an appropriate payment method

  • Review the order before confirmation

5.2 Order Acceptance

  • An order is a binding contract upon confirmation

  • We reserve the right to refuse any order without stating reasons

  • An order may be refused if:

    • The product is unavailable

    • The address is outside the delivery zone

    • There is suspected fraud or misuse

    • Payment fails

5.3 Order Confirmation

We will send confirmation via:

  • In-app notification

  • SMS

  • Email (if available)

The confirmation includes:

  • Order number

  • Product details

  • Total amount

  • Delivery address

  • Estimated delivery time

5.4 Product Availability

  • Availability depends on the shop’s stock

  • If a product is unavailable, we will:

    • Contact you for approval of a substitute, or

    • Remove the item and adjust the amount, or

    • Cancel the entire order if you wish

5.5 Order Limits

We may impose limits on:

  • Number of products per order

  • Order value (minimum or maximum)

  • Number of orders per day

  • Certain product categories


6. Prices and Payment

6.1 Prices

  • Displayed prices are set by participating shops

  • All prices are in Israeli New Shekel (ILS/NIS)

  • Prices include VAT where applicable

  • We reserve the right to change prices without prior notice

6.2 Delivery Fees

Delivery fees are determined based on:

  • Distance

  • Order size

  • Time (peak hours)

  • Promotional offers

Delivery fees are clearly shown before order confirmation.

6.3 Payment Methods

We accept:

  • Cash on delivery:

    • Please prepare the exact amount

    • The driver may not carry sufficient change

6.5 Pricing Errors

If a pricing error occurs:

  • We will contact you immediately

  • You may cancel the order without fees, or

  • Accept the correct price

6.6 Coupons and Discounts

  • Coupons are valid under specified terms

  • One coupon per order (unless otherwise stated)

  • Coupons are not redeemable for cash

  • We may cancel coupons used fraudulently

6.7 Invoices and Receipts

  • We provide an electronic receipt for every order

  • You can download receipts from the app

  • Keep receipts for any future issues


7. Delivery

7.1 Delivery Areas

  • Delivery is available only in designated areas

  • Check service availability in your area before ordering

  • We may expand or reduce delivery zones without prior notice

7.2 Delivery Times

  • Estimated delivery times are indicative and not guaranteed
    Delivery may be delayed due to:

  • Traffic congestion

  • Severe weather conditions

  • High order volumes

  • Emergencies

7.3 Delivery Address

Your responsibilities:

  • Provide a correct, complete, and detailed address

  • Add landmarks and a valid phone number

  • Be present at the address at delivery time

  • Answer calls from the driver

7.4 Delivery Attempts

  • The driver will attempt to contact you at least 3 times

  • If you do not respond within 10 minutes:

    • The order may be cancelled

    • Cancellation fees may apply

    • If prepaid, no refund will be issued

7.5 Order Receipt

Upon receipt:

  • Check the order immediately in front of the driver

  • Ensure products and quantities are correct

  • Report any issue to the driver immediately

  • Complete payment if paying in cash

7.6 Signature and Confirmation

  • We may require your signature or delivery confirmation

  • This confirms you received the order in good condition

  • After confirmation, responsibility for the products transfers to you

7.7 Contactless Delivery

  • You may request contactless delivery

  • The driver will leave the order at your door

  • You will receive a delivery notification

  • You remain responsible for checking the order upon pickup


8. Cancellation and Refunds

8.1 Cancellation by You

Before preparation starts:

  • You may cancel free of charge

  • Full refund (if prepaid)

After preparation starts:

  • Cancellation fees may apply

  • Fees depend on the order stage

After the driver departs:

  • Cancellation is difficult

  • 100% cancellation fee or full delivery fee applies

8.2 Cancellation by Us

We may cancel the order if:

  • Products are unavailable

  • We are unable to reach you

  • Fraud is suspected

  • The address is incorrect or inaccurate

  • The order violates the Terms

In such cases:

  • No fees will be charged to you

  • Full refund (if prepaid)

8.3 Returns and Exchanges

Damaged or incorrect products:

  • Must be reported immediately upon receipt or within 1 hour

  • We provide a replacement or full refund

  • We may request photos of the product

Change of mind:

  • Food and health products are non-returnable

  • Other products may be returnable per the shop’s policy

  • Products must be in original condition

8.4 Refund Timeline

  • Refunds are processed within 7–14 business days

  • Refunds are issued to the original payment method

  • Cash payments may be refunded as app credit

8.5 Sensitive Products

Medicines:

  • Medicines cannot be returned after purchase

  • Please verify your order carefully before confirming

Food items:

  • Returns accepted only in case of damage or error

  • No returns for change of mind


9. Responsibilities and Warranties

9.1 Wemo’s Responsibility

We are responsible for:

  • Providing a safe and reliable platform

  • Connecting you with participating shops

  • Coordinating delivery

  • Protecting your personal data

  • Processing payments securely

We are not responsible for:

  • Product quality (the shop’s responsibility)

  • Accuracy of information provided by shops

  • Product availability

  • Delays due to circumstances beyond our control

  • Your misuse of products

9.2 Shops’ Responsibility

Participating shops are responsible for:

  • Product quality and safety

  • Accuracy of information (prices, descriptions, images)

  • Proper order preparation

  • Compliance with health and safety standards

9.3 Your Responsibility as a User

You are responsible for:

  • The accuracy of information you provide

  • Compliance with these Terms

  • Lawful and ethical use of the app

  • Timely payment

  • Respectful behavior toward drivers and staff

9.4 Disclaimer

“As-Is” Service:

  • The app and services are provided “as is” and “as available”

  • We do not warrant the service will be error-free or always available

  • We do not guarantee specific results from using the service

No Implied Warranties:

  • All implied warranties are disclaimed to the maximum extent permitted by law,
    including merchantability and fitness for a particular purpose

9.5 Restricted Products

It is prohibited to order:

  • Illegal products

  • Alcohol and tobacco (unless permitted with age verification)

  • Weapons or hazardous materials

  • Any products that violate local laws

Ordering such products may result in:

  • Immediate order cancellation

  • Account suspension

  • Reporting to authorities if necessary


10. Intellectual Property Rights

10.1 Ownership of Content

All elements of the app are protected by intellectual property rights, including:

  • The “Wemo” name and logo (Arabic “ويمو” and “Wemo”)

  • Design and interface

  • Graphics and images

  • Texts and content

  • Source code

  • Databases

10.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to:

  • Use the app for personal purposes only, in accordance with these Terms

You may not:

  • Copy or modify the app

  • Decompile or reverse-engineer

  • Sell, transfer, or sublicense the app

  • Remove any proprietary notices

10.3 User-Generated Content

If you submit any content (reviews, photos, comments):

  • You grant us a worldwide, royalty-free, non-exclusive license to use it

  • You confirm you own the rights to such content

  • You agree not to post offensive or unlawful content

We reserve the right to:

  • Remove or modify any content that violates these Terms

  • Use content for marketing and promotional purposes

10.4 Trademarks

“Wemo” and “ويمو” are trademarks registered or pending registration.
You may not use our trademarks without written permission.


11. Prohibited Conduct

You are prohibited from:

11.1 Unlawful Use

  • Using the app for any illegal purpose

  • Violating any local or international laws

  • Ordering prohibited or illegal products

11.2 Fraud and Abuse

  • Providing false or misleading information

  • Using payment cards you do not own

  • Creating fake or multiple accounts to commit fraud

  • Exploiting technical errors for your benefit

  • Abusing coupons or promotions

11.3 System Tampering

  • Attempting to hack or tamper with the app

  • Using bots or scripts

  • Disabling or disrupting the app

  • Unauthorized access to other users’ data

11.4 Abusive Behavior

  • Harassing staff or drivers

  • Posting offensive or discriminatory content

  • Sending spam

  • Impersonating others

11.5 Unauthorized Commercial Use

  • Reselling services without permission

  • Using the app for commercial purposes without approval

  • Extracting app data for commercial use

Violation may result in:

  • Formal warning

  • Temporary suspension

  • Permanent termination

  • Legal action


12. Termination of Service

12.1 Termination by You

You may terminate your account at any time via:

  • App settings

  • Contacting customer support

Upon termination:

  • Your access to your account and data will cease

  • Pending orders will continue

  • Any remaining balance will be refunded in accordance with our policy

12.2 Termination by Us

We may suspend or terminate your account immediately if you:

  • Violate these Terms

  • Provide false information

  • Use services fraudulently

  • Behave abusively toward staff or drivers

  • Engage in activities harmful to the app or other users

12.3 Effects of Termination

After termination:

  • Access ceases immediately

  • Outstanding obligations remain in force

  • Clauses that naturally survive (liability, indemnity, governing law) continue to apply


13. Indemnification

You agree to indemnify, defend, and hold us (including our employees, directors, and partners) harmless from any:

  • Claims, losses, damages, liabilities, and costs (including legal fees)
    Arising out of or relating to:

  • Your use of the app

  • Your breach of these Terms

  • Your violation of laws or third-party rights

  • Content you publish


14. Limitation of Liability

14.1 Exclusion of Damages

To the maximum extent permitted by law, we (and our partners and employees) are not liable for:

  • Indirect or incidental damages

  • Consequential or special damages

  • Loss of profits or revenue

  • Loss of data or information

  • Cost of substitute services
    Even if we have been advised of the possibility of such damages.

14.2 Liability Cap

Our total liability to you for any claims shall not exceed:

  • The amount you paid us in the last 3 months, or

  • USD 100, whichever is greater.

14.3 Exceptions

These limitations do not apply to:

  • Personal injury or death caused by our negligence

  • Fraud or fraudulent misrepresentation

  • Any liability that cannot be excluded or limited by law


15. Governing Law and Dispute Resolution

15.1 Governing Law

These Terms are governed by and construed in accordance with:

  • The laws of the Palestinian National Authority

  • Applicable laws in Palestine
    Without regard to conflict-of-laws rules.

15.2 Jurisdiction

You agree to the exclusive jurisdiction of the courts in:

  • Hebron, Palestine, for any disputes arising from these Terms or your use of the app.

15.3 Amicable Resolution

Before going to court, we encourage:

  • Direct contact: Contact customer support first

  • Negotiation: We will attempt to resolve the issue amicably

  • Mediation: If needed, a neutral mediator may be engaged

15.4 Class Action Waiver

You agree to:

  • Resolve disputes individually only

  • Not participate in class actions

  • Not represent others in claims against us


16. General Provisions

16.1 Entire Agreement

These Terms (together with the Privacy Policy) constitute the entire agreement between you and us and supersede all prior agreements.

16.2 Severability

If any provision is found illegal or unenforceable:

  • The remainder of the Terms remains in force

  • The invalid provision will be modified to be enforceable

16.3 No Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

16.4 Assignment

  • You may not assign your rights or obligations without our written consent

  • We reserve the right to assign our rights to a third party

16.5 Force Majeure

We are not liable for delays or failures due to circumstances beyond our control, including:

  • Natural disasters

  • Wars or civil unrest

  • Internet or communications outages

  • Governmental actions

  • Epidemic or pandemic

16.6 Notices

Official notices will be sent via:

  • Your registered email

  • In-app notifications

  • SMS

Notices are deemed received 24 hours after sending.

16.7 Language

The Arabic version of these Terms is the official version.
In case of conflict with other translations, the Arabic version prevails.

16.8 Headings

Section headings are for organization only and do not affect interpretation.

18. Acknowledgment and Acceptance

By using the Wemo app, you acknowledge and agree that you:

  • Have read these Terms and Conditions in full

  • Have understood all provisions and clauses

  • Agree to be bound by these Terms

  • Have the legal capacity to accept these Terms

  • Have read and understood the linked Privacy Policy

If you do not agree to these Terms, you must stop using the app immediately.
